Payment and Pricing Terms

General

These terms regulate our Payment and Pricing, and the rights and obligations of all Users and Customers who pay or receive money in connection to the services listed on the FishingBooker platform.

It is hereby acknowledged that FishingBooker pre-negotiates certain rates with Vendors to facilitate the booking of reservations on your behalf. Users hereby authorize FishingBooker to book reservations for the total reservation price, which includes the rate displayed on the Website. Upon submitting a reservation request, Users authorize FishingBooker to facilitate reservations on their behalf.

The price of the Vendor’s services will be as quoted on the Website, except in cases of obvious error. Prices are liable to change at any time, but changes will not affect bookings already accepted by Vendors. Despite FishingBooker's best efforts, some of the Services listed on the website may be incorrectly priced. A final price will be given prior to a trip being confirmed by the customer. Errors are rare but can occur in the pricing system and these cannot be honored. FishingBooker is under no obligation to provide Services to a Customer at an incorrect (lower) price, even if a booking has been confirmed.

FISHINGBOOKER EXPRESSLY RESERVES THE RIGHT TO CORRECT ANY PRICING ERRORS ON THE WEBSITE AND/OR ON PENDING RESERVATIONS MADE UNDER AN INCORRECT PRICE. IN SUCH AN EVENT, IF AVAILABLE, FISHINGBOOKER WILL OFFER THE CUSTOMER THE OPPORTUNITY TO KEEP THEIR PENDING RESERVATION AT THE CORRECT PRICE OR THE RESERVATION WILL BE CANCELED WITHOUT PENALTY.

Subscription Models, Fees and Deposit

Users are not required to pay FishingBooker any joining or initial subscription fee(s) related to the use of FishingBooker's Services. FishingBooker, however, reserves the right to charge subscription fees at any time and will notify Users of any changes in subscription fee policies.

Commission

Vendors set a commission amount between 10–30% of the total package price (i.e., the booking and any additional expenses). The set commission acts as a security deposit under the Deposit Payments Model. After a completed trip, FishingBooker keeps the commission for use of the Service.

Deposit Payments Model

In the deposit payment model, the security deposit acts as the commission – set by the Vendor in the amount of 10–30% of the total trip price. The security deposit is charged by FishingBooker on the Vendor’s behalf from the Customer once a trip is booked, while the remaining amount is directly paid to the Vendor.

After a completed trip FishingBooker keeps the security deposit (10–30%) as a commission that FishingBooker charges a Vendor for use of the Services. In the event that a trip is canceled, FishingBooker will return the security deposit to the Customer or will forward it to the Vendor, depending on whether the Vendor’s cancellation policy was breached or not.

Online Payments Model

In the online payment model (where the Customer has the option to pay the full amount immediately when booking a trip) the total trip price acts, at the same time, as a security deposit, settles with FishingBooker, on the Vendor’s behalf before the trip.

After a completed trip, the previously set commission by the Vendor (10–30%) is kept by FishingBooker for use of the Services and the difference between the total trip price and charged commission is transferred to the Vendor, reduced by any additional fees that may occur.

All other expenses that may occur prior, during, or after the trip date, such as tips, travel expenses, and accommodation costs are to be settled by the customer. FishingBooker does not bear any responsibility for settling any costs that haven’t been presented in the total trip price.

Payment Processing Fees

Depending on the available payment method (e.g. automatic refund, PayPal, check) additional fees may occur and the money returned can be slightly different than the monies charged.

Payment Processor

FishingBooker uses Braintree, a division of Paypal, Inc. (Braintree), for payment processing services. By using the Braintree payment processing services, Users agree to the Braintree Payment Services Agreement available here and the applicable bank agreement available here. While opening an account on Braintree, users are required to provide certain information. If any of the information provided in the account opening process changes, Users agree to inform FishingBooker, Inc. in writing, without delay.

Customer-specific Payment Method

Payments of the security deposit (in both regular and online payment options) can be accepted through:

  • PayPal;
  • Apple Pay;
  • Credit and Debit cards.

Deposit payments via credit or debit card for amounts over US$500 can be made only by the cardholder or with the cardholder's approval. When making a payment by card, a handling fee may apply; please check this at the time of booking. In the event that the cardholder is not one of the passengers on the trip, a Third Party Credit Card verification process will be conducted alongside the completion of a Third Party Credit Card Form and a presentation of an Identification Document (e.g. passport, national ID card, driver's license, etc.).

All payments must be processed successfully. If, however, a payment is not completed, all monies processed will be forfeited, and the booking will be canceled.

Vendor-specific Payout Method

When a Vendor adds a Payout Method, they will be asked to provide customary billing information such as their name, billing address, and financial instrument information. Vendors must provide accurate, current, and complete information when adding a Payment Method and it is the Vendor's obligation to keep it up-to-date at all times. The information required for adding Payout Methods will depend on the particular Payout Method chosen and may include: name on the account, account type, routing number, account number, email address, mailing address, business information, etc.

Vendors are solely responsible for the accuracy and completeness of their Payout Method information. FishingBooker is not responsible for any loss suffered by the Vendor as a result of incorrect or incomplete Payout Method information provided by the Vendors themselves.

All payments by FishingBooker to Vendors will be paid via Paypal, ACH, Wire Transfer, Check, or Braintree, and can only be completed upon receipt of an appropriate supporting document. The availability of payment methods may differ depending on a Vendor’s location and whether they are an Individual or Business. FishingBooker may at its own discretion disable the usage of a certain payment method to a Vendor.

If the Vendor’s default payout method is inaccurate or invalid, or a payout cannot be made for any other reason using the selected default method; providing a Vendor has previously selected (any) other payout method(s), FishingBooker reserves the right, at its own discretion and in good faith, to select an alternative Payout method for the Vendor. FishingBooker also reserves the right to make any future payouts via the alternative payout method.

FishingBooker reserves the right to choose a different type of payment method other than the aforementioned if, in good faith, it determines that a different type of payment method is more appropriate.

Supporting document: A standard supporting document is an invoice that must be accurate and must contain adequate information concerning the chosen payout method. Additional supporting documents can be defined as a credit memo, credit request, etc., issued by the Vendor.

The Vendor's cancellation policy is set when their FishingBooker listing is created in the same way that the security deposit (which is transferred in case of a breach of the cancellation policy) is set. To receive the security deposit if their cancellation policy is breached, the Vendor must provide, within 90 days of the date the trip being canceled, the following:

  • accurate payout information
  • and/or supporting documents

Any claims of a breach of cancellation policy submitted after 90 days of the trip cancellation date may be deemed invalid.

Additional Fees and Currency Conversions

Please note that Payment Methods and Payout Methods may involve the use of third-party payment service providers. These service providers may charge additional fees when processing payments and payouts, and FishingBooker is not responsible for any such fees and disclaims all liability in this regard. Users' Payment Methods or Payout Methods may also be subject to additional terms and conditions imposed by the applicable third-party payment service provider. Users are asked to review these terms and conditions before using a Payment Method or Payout Method.

Please note that third-party payment service providers may impose transaction, currency conversion or other fees based on the currency and on an exchange rate and FishingBooker is not responsible for any such fees and disclaims all liability in this regard. Users should contact their bank or credit card company if they have any questions about these fees or any applicable exchange rate.

Customer-specific Terms

All of the Services require a deposit at the time of booking for a fishing trip to be secured. Any outstanding balance is due to be paid to the Vendor prior to using Services rendered by and booked with a selected Vendor. If a Customer does not pay their balance prior to using the Vendor's Services, the Vendor may cancel the booking and charge any cancellation fees as set out in the Vendor's cancellation policy which can be found on their listing.

With certain Vendors who accept the online payments method, customers can be requested to pay the full amount in advance – prior to the trip's date. If a Customer selects this option, they will be charged the full amount in US dollars by direct bank transfer or by credit card, and some additional charges and conditions may apply.

FishingBooker’s role is restricted solely to acting as a limited payment collection agent for Vendors by facilitating payment on behalf of the Vendor through the FishingBooker platform using a payment service provider, and these payments will be considered the same as payments made directly by Customers to the Vendor. While acting as a limited payment collection agent for a particular Vendor, FishingBooker denies any other agency or authority to act on behalf of the Vendor and assumes no liability or responsibility for any acts or omissions of the Vendor, either within or outside of the FishingBooker platform.

Credits

FishingBooker may, at its sole discretion, offer customers credit. Credit is a monetary value added to a Customer’s account, for which they may receive a deduction or refund of the deposit processed by FishingBooker for their fishing trip.

In the event that a Customer cancels or changes a prepaid reservation without breaching the individual Vendor’s selected cancellation policy, they may be presented with the option to receive a credit amounting at least the value of their prepaid deposit.

If a Customers booking has to be canceled prior to departure, they may be presented with the option to receive a credit amounting at least the value of their prepaid deposit.

If a Customer wishes to make a prepayment and make a reservation later, they may be presented with the option to receive credit amounting at least the value they prepaid.

In the event that a Customer has overpaid or is overcharged by the Vendor, they may be presented with the option to receive a credit. The User may be credited at least the difference in price.

The next time a Customer books a trip using their FishingBooker account, the credit will automatically be applied to the deposit.

FishingBooker may, at its sole discretion, create a special offer or policy under which credits can be offered to Customers as specified in the terms and conditions provided within the offer or policy. FishingBooker reserves the right, at its sole discretion, to amend credit policies and offers at any time. This does not apply to customers with pre-existing unused credits.

FishingBooker reserves the right to create a unique credit offer for a specific customer depending on a customer's history and the situation.

Unless otherwise stated:

  • Credits can’t be transferred between accounts;
  • Credits can be applied to multiple bookings until they are used up;
  • Credits are valid for a period of two years from the date the credit is received*
  • Credits are valid for the trip’s deposit. They cannot be used for the remaining balance, which is paid directly to the Vendor.
  • Credits can be issued only for trips that require only a deposit in the amount of 10–30% (they are not applicable for online payments)
  • Different types of credits can be added up;
  • Credits are covered by a six-month money-back guarantee starting from the date that a customer received the credit where a customer is eligible for a refund of the amount paid. If FishingBooker adds extra credits on top of what a customer paid, that amount can’t be refunded.
    *The two-year period counts for each credit a customer receives independently.

Vendor-specific Terms

FishingBooker will make sure that the chosen Payment service provider will transfer the security deposit to the Vendor in the event of a breach of their cancellation policy. FishingBooker's policy is to cover the Vendor's loss by transferring the security deposit (10-30% of the total trip price, with the exact percentage being chosen by the Vendor upon creating a FishingBooker listing) or the difference between the total trip price and chosen service fee if paid via online payments.

The Vendor’s cancellation policy can be overridden in cases qualifying under our Extenuating Circumstances Policy, as defined here.

In case a booking is made via online payments, it’s the Vendor's sole responsibility to notify FishingBooker through FishingBooker’s product immediately if a trip is canceled or shortened.

Vendors are strongly discouraged from asking a Customer to provide them with a credit card or any other form of financial information so the customer can give them an additional guarantee for the trip or for any other reason.

In the event that a Vendor asks a Customer to provide them with credit card or any other financial information, and the Vendor afterward charges a Customer’s credit card or receives a payment for the booking by any other means, in the event a Vendor’s cancellation policy is breached, the Vendor must return the funds they received directly from the Customer to the Customer, or contact FishingBooker’s representatives to assist them in the refund process. In the event that a customer provides a Vendor with credit card information, FishingBooker is not liable nor responsible for any amount charged.

By “prior to the trip”, we mean any date before the booked trip date established in the trip booking confirmation.

Online Payments

A Vendor may be presented with the option to receive full payment for bookings through FishingBooker. If a Vendor selects this option, they agree that FishingBooker acts as their limited payment collection agent and facilitates payment on their behalf through the FishingBooker platform using a payment service provider, and payments will be considered the same as payments made directly to the Vendor. While acting as a Vendor's limited payment collection agent, FishingBooker denies any other agency or authority to act on their behalf, and assumes no liability or responsibility for any acts or omissions made by the Vendor, either within or outside of the FishingBooker platform.

FishingBooker uses Braintree, a division of PayPal, Inc. (Braintree), for payment processing services. By using the Braintree payment processing services, Users agree to the Braintree Payment Services Agreement available here, and the applicable bank agreement available here.

If a Vendor agrees to activate the option of full payment, they will be required to provide FishingBooker with the necessary information by signing an agreement that enables FishingBooker as a Master Merchant to open a Braintree marketplace sub-merchant account in the Vendor's name.

Vendors also agree that, if any of the information required to open and maintain an account changes, they will inform FishingBooker without delay in writing.

Vendors are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to them. FishingBooker will not charge any tax or fees on top total trip price.

Anti-Money Laundering Statement

In addition, the prevention of money laundering is a key focus of U.S. regulatory authorities. Money laundering regulations are designed to inhibit the movement of funds derived from criminal activity and to restrict the availability of money to fund terrorist activities.

FishingBooker reserves the right to restrict any User's access to the FishingBooker platform or Vendor services and develop strict procedures to minimize the risk that the service could be used for money laundering purposes, including controls and monitoring tools to identify deviations from standard customer activity and identification of suspicious activity.

In order to further reduce the risk that the FishingBooker services could be used for money laundering purposes, FishingBooker does not deal in cash. All money is received and remitted by FishingBooker electronically.

Furthermore, FishingBooker reserves the right at any stage to refuse or restrict access to the FishingBooker or Vendor services if a User fails to provide satisfactory information or if information a User has provided subsequently appears to be misleading, incorrect, or false. FishingBooker does not allow money transfers intended for gaming, gambling, or illegal activity. FishingBooker will cancel all transfers associated with any such activity.

Taxes

ALL USERS HEREBY ACKNOWLEDGE AND AGREE THAT FISHINGBOOKER INC. IS NOT OBLIGATED TO DETERMINE WHETHER TAXES APPLY AND IS NOT RESPONSIBLE TO COLLECT, REPORT, OR REMIT ANY TAXES ARISING FROM ANY TRANSACTION. USERS ARE RESPONSIBLE FOR DETERMINING ANY OF THEIR APPLICABLE TAX REPORTING REQUIREMENTS, AND THE TAXES THAT SHOULD BE INCLUDED AND FOR INCLUDING TAXES TO BE COLLECTED OR OBLIGATIONS RELATING TO APPLICABLE TAXES. USERS ARE ALSO SOLELY RESPONSIBLE FOR REMITTING TO THE RELEVANT AUTHORITY ANY TAXES INCLUDED OR RECEIVED BY USERS. FISHINGBOOKER CANNOT AND DO NOT OFFER TAX-RELATED ADVICE TO ANY CUSTOMERS OR VENDORS.
